Oregon power of attorney rules in brief

  • Notarization is not always required, but usually expected. Oregon law asks only for a written power of attorney (ORS 127.005), yet banks normally want it notarized, and it must be notarized to sell or transfer real estate (ORS 93.670).
  • Durable by default. An Oregon power of attorney keeps working if the principal later loses capacity, unless it says otherwise.
  • Health care is separate. Medical decisions are made by a health care representative named in an advance directive; see advance directive notary.
  • For use abroad, add an apostille from the Oregon Secretary of State, $195.

We are notaries, not lawyers. We do not draft the document or advise on its wording; we check identity and witness the signature.
