● Completing an I-9 as an Authorized Representative
Employers should be filling section 2 of the I-9 form as stated above, but as employers can be busy in a hundred ways, they are not completely required to do so. So, if they are unable to fulfil this duty, then they can hire an I-9 verification notary public on their behalf. The notary will take over said duties and fill out section 2, including parts such as the employer’s review.
This is because the verification of an I-9 form is not considered a notarial service. That is why a notary public has a full choice of how they want to deal with the I-9 verification form.
Though, when it comes to the duties of a notary public, they should be checking the requirements and rules set by the state that they hold their notary public certificate. Some states don’t authorize this but others, such as Oregon, do.
● Notaries Should Only Complete Section 2 Of The I-9 Form
Despite the allowance of being able to complete and verify the I-9 form, notary publics only fill out section 2. Although both sections 2 and 3 are reserved for the employer, a notary public can fill out the form, and they will be known as an Authorized Representative.
Even so, the job of a notary is limited to completing section 2. When it comes to section 3, it should be limited to just the employer, as the regulations go. And the entire completion process of the I-9 form should be as professional as possible.
